| Credit Files to be Set Up for Construction Enterprises in Tianjin |

A large number of migrant workers are going to leave Tianjin for their homes for autumn harvest before October 1, the National Day. Yesterday, a 20-day citywide inspection of labor and personnel management practice of construction enterprises kicked off in Tianjin. Tianjin Construction and Communication Commission required labor service subcontractors to work with general contractors to effectively implement the registration system and monthly payment policy for migrant workers to ensure that migrant workers could receive their wages.
Current situation
It is reported that currently the urban construction of Tianjin City has reached a stage of rapid development as the result of the citywide movement to become an economic center in North China, an international port city and an ecologic city as well as the governmental efforts to accelerate development and opening of seaside new areas. From January to August this year, there were 2034 construction projects underway citywide, covering a building area of 70.93 million m2, a figure that is expected to reach 77 million m2 at the end of this year, a rise of nearly 45% over the previous year. The fixed assets investment in the city is expected to exceed CNY500 billion in the year of 2009. There are over 300,000 migrant workers working in the construction industry citywide, accounting for 30% of the total population of migrant workers in Tianjin. Along with the urban construction drive, the population of migrant workers in the construction industry of Tianjin will continuously grow in the next years, thus posing demanding requirements for labor and personnel management of construction enterprises. Analysis of economic factors suggests that as a result of ongoing financial crisis, investors in real estate industry have become prudent, real estate projects in some counties and districts of the city have been operating under capacity and medium or small-sized construction firms have been experiencing operational difficulties, resulting in arrears of wages. Industrial analysis reveals that unlawful employment practice and substandard management of migrant workers still persist and some migrant workers are forced to take extreme measures to dun for payment by intercepting their employers instead of asking for legal assistance.
Measures
As a large number of migrant workers are going home for autumn harvest during the National Day holiday, how to ensure that migrant workers get paid and the public order will not be disturbed because of arrears of wages has become the most pressing challenge facing the construction industry of the city. According to Tianjin Construction and Communication Commission, this citywide inspection began on September 10 and will take 20 days to complete in two phases. The first phase is self-examination and correction by construction enterprises themselves, in which all construction enterprises are required to identify and promptly correct any incompliance or potential arrears of wages by examining the labor and personnel management practice in all ongoing projects. The second phase involves inspection by competent authorities for construction citywide, in which construction commissions at district and county levels will set up registers of employment of migrant workers in ongoing construction projects in respective areas and examine no less than 30% of all ongoing construction projects for compliance with applicable requirements. The Construction and Communication Commission will work with relevant municipal authorities to conduct random inspection of construction enterprises in each district and county, which will cover the implementation of registration system for employment of migrant workers, implementation of monthly payment policy for migrant workers and establishment of reserve account for payment of wages to migrant workers.
All general construction contractors are required to effectively implement the registration system for employment and administration of migrant workers in the construction industry, whereby migrant workers will be first examined for genuine identity before working on construction sites and any migrant workers using false ID will be promptly reported to the local police. In case of incompliance with various rules and regulations on management of migrant workers, arrears of wages or mass appeal to the higher authorities for help resulting from labor disputes, the contractor and person responsible will be charged two times the deposit for wage payment and punished according to applicable laws.
